Terms of Service

1. About Branding Services Australia
Branding Services Australia (“we”, “us”, “our”) is a lead generation and referral service that connects Australian businesses with professional brand designers. We do not design brands or logos, we do not perform any creative work, and we do not employ designers. All creative work is carried out by an independent Australian professional who deals with you directly.
2. Our service
When you submit a brief through this website, a person reads it and passes it to an experienced Australian brand design studio. A designer from that studio contacts you directly with questions and a quote. Any subsequent engagement, contract, payment, work delivery and dispute is directly between you and the designer.
We do not charge you for the introduction. We are paid a referral fee by the design studio that receives the brief, and only when an introduction turns into paid work. That fee is paid by the studio and is not added to the price you are quoted.
We aim to respond to enquiries within 1 business day. This is a stated aim, not a guarantee, and it does not bind the designer’s own response time.
3. Our role and limitations
Once we make the introduction, we are not a party to any agreement between you and the designer. We do not:
- Guarantee the quality, timeliness, or outcome of any work performed by the designer
- Accept liability for disputes, delays, or dissatisfaction with the work
- Act as an agent, representative, or employer of any designer
- Warrant that any designer will be available or accept your project
- Certify, accredit, licence, audit or screen any designer or studio
The designer is an independent business responsible for its own work, quotes, contracts, insurance and deliverables. You should satisfy yourself as to the suitability of any designer before entering into an agreement with them, and you should have the scope, revision count, delivery schedule and ownership terms in writing before paying a deposit.
4. Estimates and tools
The tools on this website, including the branding cost calculator, produce illustrative ranges only. They are not quotes, they are not offers, they are not based on any published market survey, and no number they produce is binding on us or on any designer. Your project cost is determined solely by the designer, in the quote they provide to you, based on the specifics of your brief. Do not budget from a calculator output.
5. Intellectual property
The content of this website (including text, design, and tools) is owned by Branding Services Australia and its licensors. You may not reproduce, distribute, or modify any content without permission.
Any brand assets created for your project are governed solely by the agreement between you and the designer. Ownership, licensing and the transfer of source files are matters for that agreement, and nothing on this website varies or supplements it.
6. User obligations
When using this website and referral service, you agree:
- To provide accurate information in your enquiries
- Not to submit fraudulent, misleading, or malicious enquiries
- Not to use the service for any illegal purpose
- Not to attempt to hack, disrupt, or interfere with the website
7. Limitation of liability
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Subject to that, and to the maximum extent permitted by Australian law, Branding Services Australia is not liable for any direct, indirect, incidental or consequential loss arising from your use of the website or the referral service, or from any work performed by a designer introduced through it.
8. Changes to these terms
We may update these terms from time to time. The updated version will be posted on this page with a revised “last updated” date.
9. Governing law
These terms are governed by the laws of South Australia and the Commonwealth of Australia. Any dispute arising from the use of this website or service is subject to the jurisdiction of the courts of Australia.
10. Contact
Questions about these terms go through the form on the contact page, or the chat widget in the corner of any page. Those are the 2 ways in. The contact page sets out what happens when you send something and how long a reply usually takes, and the privacy policy covers what we do with the information you send.
